Step #5—Are You My Customer...or Are You My Client?
At this point you need to consider how you want me to represent you.
As a licensed real estate agent in the state of Georgia, I cannot represent you as your agent (i.e., be a "Buyer's Agent") without a signed agreement. This agreement is called a Buyer Brokerage Agreement, and I will give it to you when we first meet.
If you sign the Buyer Brokerage Agreement, you are my client. I can advise you and generally give you a higher level of service. I will analyze information such as comparative market data, advise you on negotiating and wording a purchase agreement, and, in general, act as your advocate in the purchase process. The remainder of the buying steps outlined here assume that you are my client.
If you do not sign the Buyer Brokerage Agreement, you are my customer. I can only perform ministerial acts for you, such as showing you properties you select and writing a sales contract with the terms you specify. Under Georgia law, I cannot advise you in any way.
